My father is 65 and I am 26. I am planning to separate from my father legally after my mother's death. But he is threatening to sue me with the maintenance law. I am ready to give in writing that I do not want any of his property. He already has a bank balance of more than a 1 crore rs and a house and some land to his name. I haven't caused him any debts or additional monetary obligations. Still he wants me to be his slave and look after his every need, failing which he will abuse me. Will I be forced to continue this relationship? Can he use the maintenance law to sue me? Please help.

A.No, Senior Citizen Act and other laws support him only when he has no financial support.

A.There no simple answer, to put like this, as father have good wealth which lead good income, he cannot take maintenance but if status and income of son is high then, father can take maintenance

A.According sec-125 Cr.P.C. deals with the maintenance , in sec-125, sub close -(d) described maintenance of parents.

It is specifically described that " If any person having sufficient means neglects or refuses to maintain (d) his father or mother, unable to maintain himself or herself "

So, Your father filed case against you, but you have valid proof that your father not dependent upon you and he has lots of source of income, then the case rejected which is filed by your father.

So, don't tense and not to Written No Objection of your fathers property, because this is your legal right.
