Builder not giving CS NOC

My home loan from bank got sanctioned on 6th July and the sanction letter was sent to builder same day. But now builder is not giving the CS NOC due to which my bank is not disbursing the amount. In all this builder is charging penalty on me due to delay in payment. Is there in any law in affordable housing projects for this with which I can file a complaint against builder and wave off penalty charges as this delay is at builders end not mine or my bank?

A.I have gone through your query in detail.
1) As you said that your home loan from the bank has got sanction on 6 July 2020 and the sanction letter was sent to the respective builder, but as the builder is NOT giving the NOC and so the bank is NOT disbursing the loan in such a case, then send the builder immediately legal notice from a Lawyer
2) And paying off the penalty charges to the builder does NOT arise as the builder itself is causing more delay to you and in this circumstances beyond your control in such a thing you can complaint against the builder through a lawyer s legal notice.. another compliant in the RERA……… can you can ask him for the refund of your down payment/ Advance and you can find a better flat for yourself in some other location and file recovery suit against him if he is NOT ready to refund you the amount.
