Domestic violence case

I am 36 years female having a kid of 3years old, seperated from husband while 8months pregnant because of his physical and mental torture. Yet not given any complaints against him. Is it possible for me to file domestic violence against h now?

A.Better to file case for maintenance on behalf of your child and yourself. There is no provision of imprisonment in DV act only you can pray for is Protection Order but your case is not of protection. Residence order and maintenance amount can be claimed in CRPC 125 application. Consult before proceeding further

A.Yes you can surely file a complaint under domestic violence act against him. Except this you may also file a petition u/s 125 CrPc claiming maintenance of you and your child from your huaband. And you may also file a police complaint aagainst your husband stating all the facts and circumstances therein

A.You can lodge a police complaint u/s.498A of IPC against your husband and in laws (if they are also involved) for subjecting you to cruelty and physical and mental torture. You can also file a DV case asking for residential right, maintenance (if you are unemployed), protection etc. Thereafter, you may be able to go for a mutual consent divorce against lumsum amount as compensation. Any local advocate's legal assistance.

A.Yes, you most certainly can file a case of domestic violence. Alternatively you can also file a police complaint against the concerned person/persons for subjecting you to cruelty, which is an offence under the Indian Penal Code. It is a cognizable offence subject to certain conditions being fulfilled.
