Gratuity pay rule Gratuity pay rule

I work in a MNC via contractual employer. I live in a different city for this job. Every year I go to home for more than a month my employer updates the joining date when I rejoin the work place. I am working here for more than 5 years. Is it legal to change the joining date every year and will it affect my gratuity pay out?
