Ownership status of terrace

Our society Sejal apartments situated in Veera desai road, Andheri West recently learnt through the feasabilty report, about the open space used as terrace by the private members residing on seventh floor
Actually belongs to society as per BMC plan. It has been fraudently sold to members and in resale members have become the owners..What is the ownership status of such a terrace. Can Society get this open space as common terrace

In such case you need to write a complaint before the municipal Corporation building proposal department alongwith approved layout plan copy and the agreement of the flat owner having exclusive right over terrace.
The municipal Corporation will look into it and issue notice to the member to rectify the viokatiin. Else legal action shall be initiated.
