Maintenance Charges for Garden Flat in Pune
1 year ago
I am a resident member of the Co-operative Housing Society in Pune, recently our CHS managing committee passed a resolution to charge maintenance based on the area mentioned in Index-2. However, the area mentioned in Index-2 is different for registrations done before and after REAR for similar series of flats. The issue is with the two flats with attached gardens each on the podium floor,
1. Garden Flat ‘A’ (2BHK) with the actual area (flat 850, terrace 150, garden 500 = total 1500 sqft) same as mentioned in Index-2 registration done before RERA. With maintenance charged as (2BHK, 1500 sqft x 3 = Rs.4500)
2. Garden Flat ‘B’ (3BHK) with the actual area (flat 1000, terrace 200, garden 800 = total 2000 sqft) however Index-2 registered after RERA mentions only flat and terrace areas = total 1200 sqft and not the garden area 800. With maintenance charged as (3BHK, 1200 sqft x Rs.3 = Rs.3600)
CHS is charging high maintenance for smaller flat A (2BHK, 1500 sqft x 3 = Rs.4500) and charging less maintenance for larger flat B (3BHK, 1200 sqft x Rs.3 = Rs.3600), with this there is no equality in maintenance charges as per actual total garden flat size and consumption.
Please advise/help on how to take this matter ahead legally to normalize the maintenance charges and seek justice.
Thanks in advance!
