Not served notice period- gratuity eligible?

Hi I have completed more than 5 years of service in same organisation but in two companies with letter of transfer.
I have not served the notice period which is 90days and I have worked 15 days without pay some leaves was balance available at that time. Am I eligible for the gratuity? Pls explain
