Severly Injured By Trainer at gym Severly Injured By Trainer at gym

I have been injured by a trainer at a prominent gym/fitness startup in India two months ago. The company and it's cofounder have been moving me in a never ending circle when it comes to compensation. My jaw was fractured at two separate positions when I was hit with immense force by the football which the trainer hit. I required surgery.They lied to me that they fired the trainer when I was visited by an employee at the hospital. Is there anything I can do?

A.Dear client u should have filed FIR after incident, but now it is late. Your case has become weak. Any way if u have medical report then u can file a case for compensation through advocate. U must have proof of joining jim and also that at the time of incident u were in gim.

Hello Sir

Unfortunately I was hospitalized and the doctor did not want me to take stress because of the fracture, and my mouth had to closed for almost five weeks. It is only now that I have got the ability to speak again and after conversing with their cofounder and several members, they keep promising someone will contact me but no one was. I was wrong to trust them I suppose. But one member came and informed me that the trainer had been terminated hence I did not see need to file FIR as action had been taken but now I have come to know he as not been fired, I am considering taking some action. I have all the xrays, ct scan etc to show proof of the extent of injury. I have sent those and bills to them when they offered to help me. But I have not heard back since. After several weeks I started tweeting at them and they returned th gym joining fees to me, as it was all done through app. But they did not offer any medical compensation. Would a compensation claim be successful?

Dear client your claim case will be successful but even to day u must lodge FIR stating that y could not do it before for the reasons u r telling me. FI R is must for claim case. keep all the original documents and fee returning corespondece with u. All will be required in claim case.

Thank you sir for your response. They wrongfully mislead me to drop any FIR because they had assured me that he had been fired. But I have come to know that he continues to train clients there. I will try to see what action is feasible for me to take.

Thank you sir for your response. They wrongfully mislead me to drop any FIR because they had assured me that he had been fired. But I have come to know that he continues to train clients there. I had asked them only to compensate me for my medical and ancillary expenses due to shifting of my family to take care of me, but after asking me to send the bills, they have not responded. Would a case seem feasible? I have all the proofs about me joining, that this accident was directly result of trainer negligence and all medical bills.

Dear Client,
You have to go through the advice of an Expert as you had followed the advice of Doctor for 5 weeks.Yes, case cane be filed against the Coach/Trainer and also the Organiser/owner.
You have to take the decision.
