Service Agreement involving notice period

My employer has recently revised my salary but they had asked to sign a service agreement of 3 lakh in which they have mentioned
“ If on the date of cessation of employment, the
EMPLOYEE has rendered service to the EMPLOYER for at least 12 months of the Minimum Period of Service. Then I need to pay 50% of amount.”
So my question is does cessation of employment includes notice period duration also??
Like for ex. If i resigned in 9 month and I’ve 3 month’s notice period so will this 50% condition will be valid ?? As the total is coming of is 12 months.

Yes, Notice Period is included as part of employment. So if you have worked for 9 months and 3 months under notice period then 50% conditions will be valid. But it will also depends on other conditions of the agreement.
