I have resigned from a private limited company on 15.07.2022. I have computer generated service certificate of my tenure of approx. 8 years and statement of full & final settlement of amount 4.8 lakhs (1.6 lakhs unpaid salary, 1.1 lakhs leave encashment as per company policy, 2.1 lakhs gratuity) through email of their Regional HR team. They were not paying my full and final settlement I sent 2 mails to HR and after 9 months of my resignation I have been called by the HR and paid 1.6 lakhs (only salary part). They are denying to confirm any date when the gratuity and leave encashment will be paid. Verbally they are threating that if I make any correspondence they will bring charge of pending duty/disobedience of responsibility against me. What I can do now?

A.Hello,
If the employer fails to pay the amount due for FnF settlement, the employee can take legal action against the employer and demand the payment of a penalty for the delay. If the employer fraudulently avoids paying the FnF amount, the employee can also lodge a police complaint.
