Mobile tower on roof top of my bunglow
I had entered into lease agreement with mobile tower company for 15 years, 9 year completed, I want to remove the mobile tower from my bunglow. The lease agreement done is not registered also the NOC from local body is not obtained the mobile tower company. They have just made application to local body and the local body had not issued any NOC etc. there is also health issue pertaining to this tower and my neighbors are already making lot of noise
A.Dear Sir,
You may get issue a legal notice threatening to approach Civil Court if mobile tower is not removed immediately. You may also claim compensation as the agreement is not registered so the company has no legal rights.

A.Firstly, in the absence of NOC of Local Authority how you entered into a lease agreement and agreement remains unregistered even after the lapse of long 9 years out of 15 years tenure making the matter as granted to the tower company.
Secondly, an unregistered agreement having no NOC or permission of local authority lost its evidentiary value and enforceability and cannot be revoked outrightly.
you may consult any Sr. Lawyer who is expertise in Law of Torts and civil matters to find out your remedies
