My parents are senior citizens and live now, we are 2 brothers. My elder brother is living with my parents and he convinced my parents to not give the property share to me. If my brother prepared a will for all the property then what can i do ? Can i ask for my property share with my parents now. can i file a legal paper for this
A.Dear Client,
In case the property is ancestral property in the hand of your parents then you being a legal heirs of your parents entitled for an equal share in the said property and your parents cannot transfer your share to other without your consent. But if the property is a Self-acquired property of your parents then they can dispose the property to any body as per their choice and in case your parents left it intestate i.e, without any Will then after the demise of your parents you will be entitled for an equal share in the said property.
