A.The answer can only be an emphatic "NO" with reference to the Indian Contract Act,1872. Only such a legal position enables the offeror I.e the prospective employer to sue for damages already mentioned and accepted. Whether it is reasonable is a question to be decided by the Court only.

A.Dear Client,

After acceptance of offer letter you are dutybound to resume your job on the joining date. You have informed your valid reason behind not reporting to your new assignment after acceptance of an offer. The Company cannot ignore your honest appeal and can not threaten you with legal action or harassment. In case the Company served any legal notice or any kind of correspondence threatening you for any legal consequences, reach out to the Office of the concerned Labour Commissioner for filing a complaint against the Company for victimization and unfair labour practice to resolve your concern. For any kind of assistance you need for the drafting of a complaint or application before the authority or Labour Court, you may contact our legal team for the purpose along with your all relevant papers
