Sir i have made quarentee for an educational loan for my son at a bank. Since the manager is the friend of my neighbour the manager sanctioned a loan to my neighbour without my knowledge using my guarentee form for my son. They filled the form (which i have signed for my son)by my neighbour and issued the loan. I am in trouble. He is not paying a single paise

A.Dear client,
The borrower of the loan should be served with a legal notice as soon as possible advising him of the legal action you intend to conduct against him for violating Section 420 of the IPC. A copy of this legal notice should also be given to the loan disbursing bank in question. Consult an attorney for advice on how to file a criminal lawsuit for fraud against the borrower with a request that the guarantor's name be removed from the loan agreement, which the borrower got by fraud and abating the fact for unrelated purposes.

A.Dear Client,
You should immediately serve a legal notice to your neighbor/borrower of the loan informing him of the legal action you are going to take against him for cheating u/s.420 IPC endorsing a copy of said legal notice to the concerned Loan disbursing Bank. Reach out to an Advocate for guidance in the matter of filing a criminal suit for cheating against the Borroer with a prayer for cancellation of the guarantor's name from the loan agreement which is obtained by the Borrower by cheating and abating the fact with ulterior motives.
