Resign issue - my company forced me
Currently my company forced me to resign and said we will give you 3 months salary, holiday pay and diwali bonus.
But you cannot go with another such company of similar products.
Is this fair?
A.Dear client,
Restrictive covenants, such as non-compete clauses that prevent employees from working for a competitor after leaving a company, are not uncommon in certain industries. However, the enforceability and validity of such clauses can vary by jurisdiction.
It's important to review your employment contract or any relevant policies to understand the specific terms and conditions you agreed to when you joined the company. Additionally, you may want to consult with a labor lawyer who can provide you with legal advice based on your particular situation and the laws in your jurisdiction.
In general, when faced with a situation where you are being forced to resign and are presented with terms that you are unsure about, seeking legal counsel can help ensure that your rights are protected and that you are treated fairly according to the applicable laws and regulations.

A.Der Client,
Your employer can neither force you to resign on any unethical ground nor can prevent you opting for better career prospect to join other company carrying out similar business or trade. Such an act on the part of your Employer is treated as victimization ad unfair labour practice u/s.2(ra) and Fith Schedule of Industrial Dispute Act, 1947. In the prevailing situation, you need to make a complaint against your employer over alleged victimization and unfair labour practice before the compentent authority i.e, iether before the State Labour Commissioner or the Central Labour Commissioner for redressal of your grievance. In case you need any legal assistance in this regard, you may contact our legal team with all your relevant papers.
