I have missed my all loan 2 emis and I have told them, right now I don't have money to pay my EMI due my family medical issue.
I have mailed all the nbfc and bank regarding my issue and they are not with me and harassing me by calling and sending home visit massage.
I told them I need two month time to repay my loan .
The recovery agents called my brother and harassing.

A.Dear Client,
Whenever any loan is approved by NBFC or FI either offline or online, a loan application bearing all the terms and conditions applicable to the applicant is being accepted by the applicant and pursuant to said acceptance and accessing your loan repayment capacity, CIBIL Record etc. your loan is approved. In case of default in repayment of the said loan as per the condition of repayment, FI takes the routine course of action permitted under relevant laws for recovery of debt lying outstanding against you even by engaging recovery agents. Both Supreme Court and Regulatory Authority, RBI issued orders/advisories refraining NBFC, FI strictly from taking any coercive or forceful action deploying the recovery agents to recover the dues from the defaulter loanee without taking the recourse available under the relevant law. Being a defaulter of a loan, in case you are getting such kind of threat calls or messages from recovery agents or any unknown entity, you need to file a complaint/GD in the local police station and file a complaint online to the RBI informing the harassment by recovery agents engaged by the Bank with a copy of the said complaint to the concerned Bank and get in touch with an Advocate with all your papers/document for guidance and for taking necessary steps to resolve the issue in accordance with the provision of relevant laws

A.Dear client,
You can file a complaint with the RBI, or you can talk to a lawyer about your rights and what you can do to stop the harassment. You may also be able to file a civil lawsuit against the debt collector if they have broken any laws.

If the agent is harassing you, keep track of all calls, emails, and SMS from the recovery agent. This will help you to document the harassment and prove that it is happening.

For immediate relief, you can go to the police station and file a complaint. This must be the first step before taking more drastic action. If the police do not provide any assistance or do not register the complaint, the client can file a civil injunction in court for interim relief against the bank and seek compensation for abuse.
