PAYMENT WITHHELD PAYMENT WITHHELD

My proprietor firm has sold legitimate goods to a proper whose owner is not paying the due amount despite repeated requests and reminders. To our knowledge, this client has cheated many others and is a defaulter. Civil suits are lengthy and expensive. Do I, a senior citizen, have any other recourse ?

A.Dear Client,
As a senior citizen facing non-payment issues from a client in India, you do have some alternative recourse options to pursue without directly going through lengthy and expensive civil suits. Here are a few potential options:

Legal Notice: You can send a legal notice to the defaulter, informing them of the outstanding payment and warning them of potential legal action if they fail to pay within a specified period. Sometimes, a legal notice can prompt the defaulter to settle the dues without going to court.

Mediation: Consider using mediation services to resolve the dispute. Mediation is a voluntary and confidential process where a neutral third party (the mediator) helps facilitate negotiations between the parties involved. It can be a faster and more cost-effective way to resolve disputes compared to going to court.

Negotiation and Settlement: Try negotiating with the defaulter directly or through a legal representative to reach a settlement. They might agree to pay a portion of the outstanding amount or agree on a payment plan.

Debt Recovery Tribunal (DRT): If the outstanding amount is substantial, you can approach the Debt Recovery Tribunal (DRT) in your jurisdiction. DRT is a special tribunal established to facilitate the recovery of debts due to banks and financial institutions, but it can also handle certain categories of debts owed to individuals and proprietor firms.
Thanks.
