I have booked a flat in March 2022, in contract the possession date is 24 aug 2023, still the amenities are not built, they have built on one block in which I have flat. They are forcing for registration and pay the rest amount. I don't want to go for registration without amenities. Can I claim them to pay loan interest amount from march 22 to till now which I have paid ( as for other customer who have booked the flat builder is paying interest for them.) Also I am expecting that builder should pay the loan interest untill registration is not done of flat with amenities

A.Dear Client,
If your status matches with the other customers who are getting interest from builders for default in handing over the possession of the flats within the agreed date of handover of possession, then you are equally entitled to the interest from the date of default i.e, from 24/08/2023 to till the date of handover of possession of flats with all amenities as agreed by the builder. So you need to approach the builder in the same order and it the same is denied, then serve a legal notice and file a civil suit against the builder for specific performance in terms of the agreement. Apart, you can also file a complaint against the builder before the Dist. Consumer Commission for deficiency in service and unfair trade practice claiming interest for default and compensation for harassment. Reach out to an Advocate for guidance and steps.
