Mental Harrashment At work place Mental Harrashment At work place

I am on my notice period but this month I have taken some leaves due to my health conditions and I haven't informed my manager because I was ready for the Leave without pay as I have no objection to that. Yesterday my manager made fun of my heath issues and humilated me as also threatened me that she will terminate me. As I asked her the the ground she just gave logicless answers and shouted at me. I am now very much disturbed and heartbroken. I am feeling helpless. Now what I can do. Plase guide

A.Dear Client,
Here are some steps you might consider:

Document Everything: Keep records of any conversations, emails, or incidents related to your manager's behavior. Note the dates, times, locations, and individuals present. This documentation can be essential if you need to take further action.

Talk to HR: Contact your company's HR department or a designated HR representative to report the issue. Share your concerns about your manager's behavior, the impact on your health, and any evidence you have. They may conduct an internal investigation.

Review Company Policies: Familiarize yourself with your company's policies on harassment, discrimination, and employee rights. This will help you understand the procedures in place for addressing such issues.

Seek Medical Attention: If your health condition is exacerbated by workplace stress, consider consulting a medical professional. They can provide documentation of your health condition and its impact on your ability to work.

Consult Legal Counsel: If the situation does not improve or escalates, it may be advisable to consult with an employment attorney. They can provide legal advice on your rights, potential claims, and the best course of action.

Stay Professional: Throughout the process, maintain professionalism in your interactions with colleagues and superiors. Avoid confrontations or emotional outbursts that could be used against you.

Explore Other Opportunities: If the situation remains untenable, start looking for new job opportunities. Your health and well-being should be a priority.

Support System: Seek support from friends, family, or a counselor to help you cope with the emotional stress of the situation.

Remember that workplace harassment or mistreatment is unacceptable and should not be tolerated. Employers have a responsibility to provide a safe and respectful work environment for all employees. Taking appropriate action and seeking guidance from HR or legal professionals can help address the issue and protect your rights.
Thank you.

A.Dear Client,
Until and unless your employment is seized on the expiry of your notice period, you are governed by the contract of employment. So, in the course of your notice period, even you need leave for any emergency purpose, you have to get permission for leave you availed for a health issue whatever be the nature of leave i.e, with pay or without pay. So your unauthorized leave shall be treated as an absence from a job without permission and may be termed as misconduct as defined under the model Standing Order which is applicable in an establishment where no certified standing order is in force. Accordingly, the employer can initiate disciplinary proceedings against you for the said misconduct and can even terminate your service after serving you a show cause and holding a domestic inquiry into the charge. So in the emerging situation, you need to negotiate the matter with the employer suitably and to resolve it amicably. Otherwise if the employer terminates you for proven misconduct, that stigma may adversely affect your job career in the long run.
