A.Dear Client,
In the absence of a specific stipulation in the offer letter or contract of employment, an employer cannot demand back the F & F Settlement dues for non-performance of of notice period by an employee who tender his resignation from the service. So, go through the terms and conditions of your offer letter carefully and if that letter bears no specific stipulation, then you need to serve a legal notice to your employer and file an application under Sec.33C(2) of the Industrial Dispute Act, 1947 before the concerned Labour Court claiming your dues receivable on cessation of employment from the employer.
