My brother used my mother's pension money through ATM cards without letting her know. She was ill and was always threatened. She never complained to anyone and died one day. Now the bank has no money left and as a daughter do I have right to that account's pension money taken away by son through ATM cards? He used to take out that money on mother's name and used on himself and his family.

A.Dear Client,
Under Sub Rule 6 (iii) of Rule 54 of Central Service Rules, an unmarried daughter is entitled to a family pension until she gets married or starts earning whichever comes first. If an unmarried daughter is the eldest among all the siblings she is entitled to receive a family pension, in the event parents are not alive. If both mother and father are governed by the pension scheme, then the daughter is entitled to receive two pension amounts. You may contact or visit the office of the pension disbursing authority and pension disbursing Bank to get more information and clarification in the matter.

A.Dear client,
It will be difficult for you to prove that the money was taken out by coercion or fraud as the main evidence your mother has expired.
Still, you can send him a legal notice.
