Good Greetings,

My name is Sakshi Tyagi from Ghaziabad, Uttar Pradesh, India.
I am 20 years old, and I am fed up from my family's toxic behavior, they beat me a lot and they 24×7 blackmail me emotionally.
I am not allowed to make friends and even continue to go my college. I am doing BBA and this is my last year. I have proof how my family beat me.. Only I want to ask although if I leave my home my family will just announce me as dead.. And they won't see my face again.. But in case police report is made and they search me what are my rights?
I am mentally prepared for this move out.
Kindly help me.. As the days are passing my situation is becoming suicidal.
Thanks
Looking forward for your reply.

A.Dear Client,

If you find yourself facing continuous threats to your safety, experiencing mental and physical harassment at home, it's crucial to seek assistance. Connect with a social worker or a non-governmental organization (NGO) that specializes in providing support during crises. This kind of situation is unfortunately not uncommon across the country.

If you are economically dependent on your family and leaving home is not immediately feasible, consider arranging for an independent source of income to gain financial autonomy. While you cannot legally compel your family to maintain you as an adult, you have the right to live a life on your terms.

In cases of physical harm or abuse, you can file a complaint against your family under Section 12 of the Protection of Women from Domestic Violence (PWDV) Act, 2005, at your local police station. Additionally, you can submit a complaint online to the National Human Rights Commission (NHRC) via their website (https://nhrc.nic.in/complaints/complaints/how-to-file-a-complaints). You may also reach out to the Chairperson of the National Commission for Women (NCW) at [email protected] or file an online complaint to address issues faced by women. State Human Rights Commissions and State Commissions for Women are also empowered to investigate such complaints.

A.Dear Client,
When you are experiencing such type of continuous threat to your safety and security including mental and physical harassment in-house, you can get in touch with a social worker or NGO who renders dedicated service to help you out of the crisis. This type of attitude is common among homes across the country hence it is not an isolated incidence. If you are economically dependent on your family you may not have any choice other than remain in the same house and continue with your life. If you feel you can manage outside without the support of your family for all your needs, nothing prevents or restricts you from walking out of your home to look for the destiny of your choice. You cannot legally compel your father/family to maintain you as you are an adult. Therefore, you need to arrange for an independent source of income to live your life on your own terms. You have the right to file a complaint against your family if they beat you or hurt you in the local police station under Sec.12 of the PWDV Act, 2005. Apart from this, you can make a complaint online (https://nhrc.nic.in/complaints/complaints/how-to-file-a-complaints) to the Chairperson, the National Human Rights Commission, New Delhi and the State Human Rights Commission along with the Chairperson, National Commission for Women and State Commission for Women who are empowered to investigate complaints related to issues faced by women by sending an email to [email protected] or filing an online complaint. Further, you can also approach the State Commission of Women situated in your state, and seek help from the NGOs who rendered dedicated service to the women in distress.
