Hello mam/ sir, I got married 5 1/2 years back, now I am having 4yrs old girl child. For the day of marriage, my husband creates a problem with me for cheap reasons and send me out. For the days of the marriage of most of the days, I am in my mother's home. After my girl childbirth again my husband torcher me, so I was committed suicide. after some days again I went to the husband's home, again he torcher me, so I decided to continue my studies, now I am in 3 years of Ph.D. from the date my joining daily my husband and husband family members created the problem, daily I faced the problem. many times my husband bitted me, each and every day me and my child losing the happiness.
1. But now my husband black milling me with his lawyer, must drop ur studies otherwise I will apply divorce to court and I will marry another girl. u need life mean drop ur education. (this is my problem).
2. From the days of my childbirth up to date, my parents spend money on me. my husband's family members enjoying with my husband's salary. But for me and child each and every day struggling for money.
(what to do).

3. if he will send a divorce notice me, what to do
4. I am strongly said that in my life I will never give divorce to my husband because my child needs a father. I want justice for my child.

A.Dear Madam,
You have several options and you may initiate one by one and get relief you may file DV case seeking following reliefs.

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent,
2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
3. Pass orders u/s 18, in totality against Respondent1 to 3,
4. Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.
5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited,
6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition.
7. The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,
8. That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.

A.If he send legal notice to you then you can give reply notice stating therin which harassment he had done to you.And also you can claim maintenance to you and your daughter.Thereafter you can file application under Protection of women from domestic violence Act against him and his family members in court.In that application you can claim maintenance, house rent or house accommodation, protection from torture etc. In that application you can also claim interim maintenance from him till final disposal of your application.
