Main Saadi ke baad kuch dispute k karan apne wife ke saath 10saalo se ghar se alag hoon.mere father ka dehant ho chuka hai.kya main Apna hissa k kiye pettion file kar sakta noon.

A.See there are some points which you have not cleared 1. if property is one which your father earned from his own money or earing?
2. whether it is ancestral property? 3. whether your father has left any will? 4. if your mother is agreeing or property is in her name or any family settlement took place previously?
you need to give complete detail then only such query can be addressed.
in case will (vasiyat) is there and your father had property from his own income then it will be divided as per will.
if property is ancestral then you can claim for your share .
in such case partition suit is filed.
