A. Dear Client,
Once the EMI against a loan is not repaid for consecutive 3 times by the borrower for any reason whatsoever, it is treated as NPA. Accordingly, Bank sends notice to Borrower asking him/her for repayment of the entire dues lying against your loan offering suitable terms. In the absence of any response for the Borrower, they started the routine process of action prescribed under relevant laws for recovery of debt lying outstanding against the Borrower and the Guarantor. A. Dear Client,
If the property is bought in the name of your father who left it intasted i.e, without a will, then all the surviving legal heirs are entitled to an equal share in the property as per the Hindu law of inheritance. So your brothers cannot sell the property until and unless the property is partitioned through a civil suit. On receipt of individual shares following the court's order, your brothers are entitled to sell their own shares only. Reach out to an Advocate for guidance and s ...ReadMore

icon Flat purchase in private scheme of SRS

Hi I am planning to purchase a flat in private scheme of SRA in Mumbai area (Malad/Kandivali). Builder has demolished slum and is building separate buildings for Slum and separate building as private

A. Dear Client,
A property built up in SRA land got a lock-in period of 10 years to sell or buy. If the building is constructed on SRA land, then the Builder can not sell it without the consent/NOC of the concerned authority. Even after the cessation of lock-in period, you need to take permission from the authority for the redevelopment of the building built-up on SCRA land. So before buying the property, you need to clarify the matter from the office of SRA.

A. Dear Client,
In the real estate sector, both JDA and POA are required to be registered under the Registration to make it valid and enforceable. If there is a clause specifying the breach of trust or breach of any condition of the Agreement, the land owner can terminate or cancel the Agreement, then after serving a legal notice, the land owner can file a civil suit praying for cancellation of JDA on the ground of breach of contract or condition of agreement by the Developer and on receipt of cour ...ReadMore

A. Dear Client,
A contractual and fixed-term employee is governed by the contract of employment. If your letter of appointment makes you eligible to get that allowance, you may approach accordingly to the concerned authority for disbursement of hardship allowance payable under the 7th CPC Rules. Usually, risk and hardship allowance is available to defense personnel, Railways, Air force, employees attached to disaster management etc. who are on permanent roles of the deptt.

A. Dear Client,
In the absence of an order from a competent Civil Court, a registered Deed of Conveyance is not cancelled. You may serve a legal notice to the concerned broker informing your intention to file a criminal suit against him for unruly threats with ulterior motives. Reach out to an Advocate for guidance and steps.

A. Dear Client,
In standalone housing complexes having a small number of residents, it is a common nuisance faced by the residents of the flat everywhere. In the absence of a registered flat owners association, you along with other flat owners, may politely approach the flat owners for cooperation in this regard to meet the common interest and purpose. If no change in attitude in the errant residents of the ground floor is observed after multiple requests, you may bring the unruly and irrational b ...ReadMore
