Failure to repay the loan makes the loanee liable to face legal consequences including a case under Sec.138 of N I Act for the dishonor of cheque issued by the loanee for repayment of a loan or under SARFAESI Act, 2002. As per the information you have mentioned it is suggested to you that If the borrower is unable to make the repayments, the lender has the legal authority to sell the assets pledged as collateral to recover the outstanding loan amount. However, even in this situation, the bank is required to issue a 30-day public notice before auctioning off the assets
