A. Dear Sir,
U have to file eviction suit after issuing mandatory legal notice as provided under section 106 of transfer of property act. but it is time consuming, u may sell the property to a stronger person and he may get him evicted by using muscle power.

If you are really not involved then you may keep quite otherwise you have to seek the help of local advocate of that State and get a full information about the registration of FIR if any and get anticipatory bail if required and also go to High Court to quash such FIR.

It is weakest enactment as such nothing will happen if you file such Domestic Violence case. They will engage advocate. The only benefit you may get is interim maintenance after few months. Better file complaint with Police under Section 498A of IPC.
