Hello, I have taken a mortgage loan against a property a few years back from a mandali. I had given a blank cheque at the time of taking the loan. Recently, I have failed to pay the EMIs and they fill


A. Yes they can file both cases.
Yes they can sell of the property [provided they give you notice of the same and also reasonable grace time to repay the debt and get back your property]
The point of the 138 NI Act is to again make you repay the money.
You can git rid by the above case in 2 ways

1. Repay the money
2. Go to high court under section 482 CrPc and file for quashing

A. It will certainly raise eyebrows of the court, since he had not filled the cheque himself and handwriting will be different if you fill up his cheque. A. deposit cheque in bank. once cheque is returned to you then send legal notice through lawyer but don`t use the words that the cheque was issued for security, the notice should state that he issued it instructing you to fill that date and promising that it would be honoured.

A. Bank can not do like this since the property is already mortgaged as collateral security. Bank can recover dues by selling the property mortgaged. Filing case under the NI act are nothing but blackmail. Hire a good lawyer to contest your case

A. You must issue a legal notice through a lawyer to the concerned branch and to its head branch stating all the facts and circumstances in details asking them to pay you damages and compensation.
