Please approach High Court to stay the investigation and to quash the FIR. Another petition may be filed in the High Court to initiate criminal action against her since she is anti-social element as she is blackmailing your son though she is married having a child and not got divorce in respect of second marriage.

Both the son (brother) and the daughter (sister) are equally entitled to the father's self-acquired and ancestor-owned property.
It makes no difference if the daughter (sister) is married or not. But if the property is given through will, then the sister has no right unless the brother dies interstate and has no legal heirs.
