even if property is on her name, she can not throw you out. This is cruelty and you can take divorce for this reason.

A. no disadvantage because maintenance will become permanent. without divorce also the maintenance have to be paid.

A. Hi,
Since your husband has expired you are the legal guardian of your daughter. If the in-laws are not allowing your daughter to come to you then you can file an application in the court for her custody. Also, you can claim a fair share in the property owned by mother of your deceased husband.

Firstly, you cannot file any partition suit. Only there is very limited scope if you are governed by the 'Mitakhshra' school of law.
Secondly, No, you nor your son are entitled to get any share from your father's property which may be self-acquired or ancestral.

It is advisable that you clear out the issue with the police over phone or mail. You can also ask the police to send you a copy of the complaint. You can also file a complaint for false FIR against you.

A. Suicide is definitely not an answer for your problem. Take wise decisions and move ahead. Try for amicable solution through common friends and/or relatives and you can simultaneouly approach Court too and file restitution of conjugal rights Petition and ask your wife come back legally and compulsorily.
