No legal action can be taken against them, as this was an informal agreement to marry. However, if you have suffered injury due to their abuse, you can file a complaint under the Domestic Violence Act.

Under S.89 of the Mental Healthcare Act, you can make an application for a mentally ill person who is not receiving treatment and is a danger to himself and those around them. This will have to be corroborated by an independent psychiatrist over a period of one week, and only if he is satisfied that your mother needs hospitalization will the section apply. Once the conditions have been met, then your mother can be institutionalized until she is better.
