A. Dear Client,
A house or building erected or constructed on the ancestral land is classified as ancestral property and the status of that ancestral property cannot be affected by any legal her/coparcener without the consent of other legal heirs/coparceners who got the right to said property by birth. Your parents being one of the coparceners of the said undivided ancestral property cannot demolish the building without the consent of other coparceners. And if so happens, other coparceners/legal he ...ReadMore

A. Dear Client,
Certified copies are admissible as evidence in court. They carry the same weight and legal significance as the original documents they represent. A certified copy having the seal and stamp of court issued thereunder is not a copy of the original document but is a copy of the registration entry which is itself a copy of the original and is a public document under Section 74(2) of the Evidence Act, 1872 and Sub-section (5) of Sec.57 of the Registration Act, 1908 that makes it admissib ...ReadMore

A. Dear Client,
Under section 9 of the Hindu Marriage Act, any spouse can file a petition before a district court for the restitution of Conjugal Rights(RCR). This remedy can be sought by either the husband or the wife who has been deserted or separated from the other spouse without any reasonable cause or excuse. If the husband wins the Sec 9 (RCR) case then the wife is not entitled to Maintenance under Sec.125 CrPC. The decision in a suit against the wife for restitution of conjugal rights is e ...ReadMore

A. Dear Client,
There were significant changes made to Section 497 of the Indian Penal Code (IPC). The Supreme Court of India, in its judgment in September 2018, declared Section 497 unconstitutional and struck it down. The court held that the provision was discriminatory as it only punished a man for adultery and not the woman involved.
After this judgment, adultery is no longer a criminal offense in India, and the legal perspective has shifted towards personal matters rather than imposing crimina ...ReadMore

A. Dear client,

Firstly explain the scenario to your husband. If required keep recordings of such actions. Speak to other family members, who can really help you. If all these doesn't work you have to lodge a complain under Section 498a, an FIR against your MIL,this might ruin your relationship with your husband. You have to be mentally prepared before taking such steps.
I would suggest you to first amicably settle the matter, then go for any such legal remedies.

A. Dear Client,
Firstly, try convening your parents. If they are still not agreeing and if you both are major you can be married legally and then if you want you can live separately from your parents. Just the marriage should be legal.
