A. Dear Client,
If a minor should receive a gift deed, the minor's guardian will be responsible for acceptance of the said gift. Once the minor turns 18, he/she can either accept the Gift Deed or refuse it. In the event where the adult refuses to accept the gift the Deed will be void and the Donor has to withdraw the gift. The minor on her own cant accept a gift deed as she is a minor.

Property during the pendency of a suit or proceeding cannot be transferred or otherwise dealt with by any party to the suit or proceeding so as to affect the right of any other party thereto under any decree or order which may be passed therein except under the authority of Court. The transfer of property is not valid. Hence, you can file a petition to restore the property to the respondent's name.

No, they cannot cancel Partition deed. However, if they can seek a declaration by filing a suit that the said partition was a result of fraud, then the court might consider calling the deed as void. For declaration, ythey need to file a suit before Court having jurisdiction.

You are not wrong. It's always better to make the widow responsible for the assets to protect her rights. If not the entire share, she should definitely have complete ownership of a part of your father's assets. You can suggest your brother to divide the assets into 3 parts where your mom gets one, you get one and your brother gets one. All of you will have the absolute ownership of your shares and your mother can transfer it to anybody later on according to her wish.
