icon Gift Deed - property in Bangalore

I have a property in Bangalore which I want to gift to my daughter. Can she execute a power of attorney to her mother to receive the gift? She is presently not in a position to travel and receive the

A. Dear Client,

If a minor should receive a gift deed, the minor's guardian will be responsible for acceptance of the said gift. Once the minor turns 18, he/she can either accept the Gift Deed or refuse it. In the event where the adult refuses to accept the gift the Deed will be void and the Donor has to withdraw the gift. The minor on her own cant accept a gift deed as she is a minor.

Thank you so much, I hope this answer helped you.

A. Dear client,
You are not wrong. It's always better to make the widow responsible for the assets to protect her rights. If not the entire share, she should definitely have complete ownership of a part of your father's assets. You can suggest your brother to divide the assets into 3 parts where your mom gets one, you get one and your brother gets one. All of you will have the absolute ownership of your shares and your mother can transfer it to anybody later on according to her wish.

After my father passed away, I filed a case to get my share in the family property. Will the court have powers to order me to forgo my share on any grounds?

A. Dear client,
The court cannot ask you to forgo such property-related rights so easily. You will be definitely entitled to your share of the property and you can continue with the legal proceedings that you have already started.

In my village mostly gram panchayat property is captured by many people due to this my street all water flow in many places how to get relief from this

A. Dear client,
You should talk to the Sarpanch of that particular gram panchayat about this issue. He cannot just let people acquire gram panchayat's land. It is the government's property and it is his duty to protect it. If he fails to take action, then please write a letter to the Tahsildar or the superior officer and I think they will definitely help you with your problem.
