We have started the construction of our home by labour contract. But due to some disagreement we had to stop the construction. Now the labour is asking for excess payment. We have already payed him excess amount in the name of festival advance. now he is not willing to continue the construction and has threatened to harm us physically.

A.Dear client,
1) ask the builder to give detailed break up of amount payable towards service tax , late fees etc
2) you should insist on a demand letter
3) also receipt for payments made by you
4) don't pay without any demand letter
You don't have to pay him if he is not willing to continue. If you have a formal agreement, then you can sue him for specific performance. If not, give a police complaint in your local jurisdiction.

A.Dear Client
If he is threatening to harm you then you can initiate a police complaint by going to the local police station. Tell the police all the facts and also that you have already paid excess money to him.
