Bank refunds without GST!

I had been charged by ICICI Bank for late payment charges with GST after calling to customer executive they agreed to refund late payment charges excluding GST charges,my question is can we ask refund for those GST charges also since they get refund from government later

A.Hi,
Request bank to refund the late payment charges without getting into the GST issue at the beginning, once paid the amount you may file for GST refund
