Sir I am working with SBI as manager one of my borrower has vacant the charge from Agriculture land on the basis of photocopy of no dues the original is in bank which is issued by me but not delivered but the police says that it is a case of fraud which is committed by borrower with the help of me and arrested me 2 years ago right now I am on bail given by high court. The bank is filled a FIR against the borrower. I also tried to re-enter the charge on land and the tehsildar was also issued the order but it was not marked by the patwari. The borrower had also filed a complain that he was deposited the amount but the loan has not closed by me which complain has declined. The borrower also applied bail from high court which is also declined. Sir please guide me accordingly what I will do.

A.1. whether the No dues issued by you were properly issued by you, means, whether the loan was cleared and no dues were pending on the date of the issuance of NDC? I am not asking about original or duplicate, just clarify whether you had issued the no dues after following the due process.
2. how did the borrower obtained the photocopy?
3. what was the FRAUD?
4. since you are on bail, what about the charge sheet, and the sections imposed?
5. why did you tried to re-enter the charge? it means there was a charge on the land and you issued a false/frivolous document (no dues)
6. do not spoil your case and job,
i advise you to contact me or any other lawyer of your choice along with the relevant documents (FIR, Charge sheet, other documents) for a thorough discussion to establish your defense,

Its too common case nowadays. Customer awareness is more. Its too simple File squash petition by a advocate in High Court. As per your statement, you have may merits. Try. Best of Luck

A.Hi,

This is very common issues we come up now and then, I request to follow the below:-

A. get to know the chargesheet status, if they charged you in the charge sheet and the final report already filed before the court, then move a discharge application along with solid and good grounds. ( please get a copy of the same and look at that by yourself).

B. I am sure there is a good possibility that the court may discharge you depend on the grounds and charges level against you in the charge sheet.

C. get all the documents and discuss with your lawyer

A.Dear Sir,
Such cases are frequent and innocent officers like you are the scapegoat. Nothing to worry. Please hire the legal services of senior service advocate and on legal point get discharge or quash the FIR if charge is not filed. You will justice in High Court or Supreme Court only. You should not go for trial which may take years together.
