I am currently working in company which is dealing service sector from past 1 year.Now I want to open similar company with similar kind of service but while joining company,I signed agreement with company that I would not engage in any of such practice for 3 years. The exact words are:
That during the course of employment with xxx, Employee will be exposed to confidential information, trade secrets, proprietary knowledge, technical know how, customer database all of which is the property of xxx. Employee shall not engage / conduct / perform any business and/ or trade and/ or transaction which is similar to the scope of employment as detailed in this Agreement for a period of 3 years from the date of execution of this Agreement and shall not use any proprietary information of xxx for any such any business and/ or trade and/ or transaction. Employee acknowledges that this condition is reasonable and an essential condition of this Agreement.
Please help me to find a solution of this problem and how can I open my company on my own name.

A.You must not do so as that will mean breach of the confidential agreement that you had signed with them an for that they can very well take you to the court and seek (huge) compensation from you. Now you are left with these options;
1. Wait for three years
2. Seek the existing company's consent in writing and then go ahead and start your business.
