My real uncle has borrowed loans from 3 banks keeping my mother and myself as co-borrower/guarantor on the loans without our consent. Neither me or my mother has signed any loan documents or visited a bank for that purpose. I am seeking for a legal advice on how we can clear our names from these loans as bank recovery agents are harassing us to make the outstanding payment. I approached local Police station in Dec'19 for FIR but they are not taking it and the least I was able to register a NC. Also, my uncle has gone absconded since February 2020.

A.First lodge complaint with head office and police and also file private complaint and get such documents examined by hand writing experts.

A.Have you informed the bank about this? You should first send a notice to the bank about this forgery. Secondly if the police is not registering the FIR then you should write to the SP. At last if FIR is not registered then you should approach to the magistrate for seeking direction to the police to register the FIR.
Beside this you should also file a declaration suit in the civil court asking for the declaration that you and your mother does not have any liability towards the bank.

A.I have gone through your query in detail.
1) Let me bring it to your notice that some of the bank people and their recovery agents just tell haphazardly that your names are there in the Co- borrower and the guarantor to frighten you. (All these must be Private Banks)
2) And as you & your Mother have not signed any of the documents in the bank defend them straight away and deny all the allegations (Tell them to provide you with the Loan Agreement Xerox)
3) Since you are saying that you are uncle has gone absconding since February 2020 you have nothing to do with your uncle and his loans... Don't worry keep all your phone call recording Ready as to what the bank people are saying it will be good for defending your case.
4) You may also write to the banking Ombudsman if you have the Loan Account Number & Details
