We are staying in a rental apartment from 6 months.There is no lock in period but we need to give one month notice. we informed him On May 12th , so notice period will be till June 12th ,we will leave the property may 31st we told him that we will pay next month 12 days rent while leaving but he is saying we need to pay full amount for the next month.what we need to do now ??

A.Dear Sir,
If there is no notice period. Then reasonable notice period of one month has been given by you. And you just pay 15 days rent and leave the house. He can do nothing. If you have given advance then it will be a problem. He seems to be a greedy. Then tell him that you will leave bad feed back on the prospective tenants and that he is unable to get any tenant for the next six months.

Hi sir, thank you for your reply....but every month we are paying rent on 1st ....we informed him on 12 th that we will leave on 31st and will pay rent till 12th....so he is saying ...that count will be from 1 st to 1 st...if you Inform middle of the month ....you should pay full month rent irrespective to the notice period....is his calculation correct.? He was saying everyone following this same rule...

A.Since there is no rental agreement no need to pay for the month of June.

Thanks for your answer.....we have agreement..lease period is 11 months...but there is no lock in period...we need to give then one month notice period...that notice period will end mid of the month that is why he is asking to pay full month rent....it is not correct right.. could you please give some suggestion..

what is notice period mentioned in that 11 months agreement. If there is no notice period mentioned then you can issue notice and vacate the flat. Hope same is clear.

One month notice mentioned in the agreement... according to that agreement only we informed him this month 12 th...so notice period will end next month 12 th right...we already paid this month rent...so next month we thought to pay remaining 12 days rent...but he is asking full month rent...

Since one month is mentioned in the agreement you have correctly issued one month notice. so Legally as per your contract no need to pay any extra amount for the remaining month.
