I am R a second buyer of a resale Flat of Mr V.
Flat is still under construction.
When I bought its cost was 31 lakhs as per builder.
29 Lakhs were already paid by V.
2 Lakhs were balance which was to pay by me (R) as last instalment at the time of possession.
Agreement Date was 31/08/2016 and last date of possession was 31/08/2018.

Now builder increased the cost of Unit by inserting charges as Meter cost 51000/- and Power Back up 55000 + GST = More than Rs.1,08,000/-
Builder not giving penalty for late possession saying that you (R) are a second buyer so you are not entitle for it for 2 years from purchase of this Unit. I bought on 31/10/2017 so he denied up to 31/10/2019. Only 4 months penalty from 01/11/19 to 29/02/20 he is ready to pay.
My Request:- If I paid whole amount whatever builder demanded because he is going to impose late payment penalty to me. Can I file case after getting the possession for increased cost & late possession penalty ? And what is period will be available with me to file case.

A.Dear client
Builder has no right to say to you that you cannot get penalty because u are a second buyer. Before getting possession only you can file case against the builder in civil court or in consumer forum for delaying the possession.
The limitation period is 2 years to file consumer case. To get penalty you can go through the agreement which was signed by you and the builder.

A.You cannot file any case after getting possession because builder may include all such classes in the sales deed your advices to get the possession immediately by paying penalty since your agreement is expired and you have a weak case.

A.The stand of builder not making payment of penalty is frivolous. If chose to file consumer case claiming penalty etc then limitation is Two years only so you can file after taking of possession also within two years.

A.First see the agreement and terms and conditions at the time of buying of flat. Take an appointment from lawyer hive notice yo builder zRERA is there , you can ho to consumer court too

A.As you are saying that 2 Lakhs were balance which was to pay by me (R) as last installment at the time of possession & as he has NOT given you possession so the builder should be dragged in court & a legal Notice should be sent to him immediately. Again the agreement signed by you has to be review for your query to be answered in detail.
