Any Option to Recover Penalty for Late Possession and Increase Cost of Flat. Any Option to Recover Penalty for Late Possession and Increase Cost of Flat.

Dear Sirs,

- I had purchased a flat from 1st Buyer of a Tower in Oct-2017 at Bahadurgarh in Haryana.
- Now flats are ready for possession and builder has demanded last instalment since March-20.
- And I have paid the last instalment to avoid late penalty on payment but possession still is awaited.

a) Builder has increased the cost of Flat by Rs.105000/-for power backup & meter cost.

b) Builder is denying paying penalty for late possession for 2 years from endorsement date 24/10/17 to 24/10/2019 (2 years as I am second buyer). He has taken my signature through broker on a clause in endorsement letter that two possession period will be calculated from the date of endorsement letter.

Last payment is already done by me and builder is going to hand over Possession soon.

¬¬¬----> Can we file case in consumer court after taking possession for both penalty for late possession and increase in Flat cost?
Regards,

Verma
