Dear Sir/ Madam,my daughter was married in April 2016.She have a male child of 2 years.Their husband is medical representative (MR) at Kalyan, Thane, Maharashtra. He was coming late night daily.When my daughter was asked to him, he replied repeatedly I was in meeting.He was found as drinker. Since last year , he is tailing to divorce.He does not ask to child and wife.He had bitten many times to her with their bhabhi (beautition).He is loving with other lady and wants to marry with her.I have four daughters and one son.All of them daughters are graduate.He did not allowed to her on any job.My daughter was selected for B.T.C. on the basis of marit..Now daughter's career and their son development is very difficult. How many days I can help?If I case this file,justice will not find without mony.Kindly help me soon.

A.if your daughter wants to remain in the matrimonial relationship, then ask her to try to settle the matter amicably with her husband involving elders/relatives/friends etc and start afresh, and if, failed, file Restitution of conjugal rights petition in the Court,
and,
if she wants to terminate the matrimonial knot, then,
try to settle the matter amicably with her husband involving elders/relatives/friends etc and go for Mutual Consent Divorce which will be decided in 6-18 months, and both will be free to live life with wish,
don't forget to draft an MOU before approaching Mutual Divorce, which is the most essential and important part of a Divorce case to avoid/reduce future legal complications,
some basic points to keep in mind and put in writing through an MOU before filing the petition for mutual consent divorce are custody of kids, distribution of assets (movable/immovable), quash/withdraw of pending litigation if any, Maintenance (present/future), Alimony, mode and time of making the payment, streedhan, future litigation, etc.
if failed, she can file/claim
498a complaint (for causing mental, emotional, physical and monetary abuse, etc)
Domestic Violence case (for causing mental, emotional, physical and monetary abuse, etc)
she has rights to claim residence, protection, compensation, maintenance,
if she does not want to opt the divorce presently, can ask for judicial separation also,
