Sir /madam iam married for 6 1/2 years .i filed case against my husband 498a.now they are selling all their properties.but my is a drinker and not asking them share. For sake of my children i want hold their properties not to sell.please give guidance.

A.Dear Client,
As per your inputs your joint family assets are trying to sell by your in laws, if you have children then as a lawful guardian of your children who have legal share in the properties file a petition for partition in the court further file a stay petition in the court to stop all the steps of sales

A.If its an ancestral property
Then your children’s have equal right in that property and you can claim through them

A.If the property is self acquired property of your in-laws then you can not demand share by surpassing your husband. But you can demand maintenance from you husband for yourself and your children.

A.If the property is ancestral property than your children have inherent right in that property and you can take stay order from court for not selling property . And than file suit for partition of property .claim maintenance from your husband for you and your children.do it immediately.

A.1. you can file a civil suit seeking an injunction on the sale of the said properties since the children have a vested interest in the same,
