Misuse of my property

I have given power of attorney of my house to one of my uncle for some personal reasons with all the proper documents, I recently vacated that house for some vaasthu issues and told my uncle to sell the property. He then sold it to someone else but didn't pay me back. I got to know about it after pandemic. tried to settle down the issue many times but no use. What should i do?

A.Hi,
It is advisable that you send him a legal notice demanding him to pay your dues and if the matter is not settled then you can file a suit against your uncle for criminal breach of trust in the court.

As per your inputs your uncle violated the terms of PA, issue a legal notice to your uncle and the buyer of your property, later you can issue legal steps against them

A.1. file a formal complaint about cheating, criminal breach of trust against your uncle,
2. you can also serve him a legal notice through a lawyer to make payment of the outstanding amount along with the interest,
3. if payment is not made despite service of the legal notice, you can file a civil suit for the recovery of the amount,
4. POA, Property docs, chat, call records, WhatsApp record, if relevant, can prove your case and are admissible as an evidence

A.You can file a criminal case for breach of trust and criminal misappropriation of property, he will settle the matter. This is also a fast and effective way to get your money. You can also file suit for cancellation of sale deed and poa adding the purchaser as party to the suit. If the advice is useful, please give me rating.
