Some lawyers says that i can't ask my share in the ancestral property of my mother's father if mother's father died ?
&
Some lawyers says i can ask within 3 years of attaining majority ? Majority age is 21 or by including next 3 years, it becomes 21 ?
From both which one is true ? I'm from haryana, we are not joint hindu family... Only hindus..
My mother is alive & can i ask my share, under which section ?
Will i also get mother's share Or only my share ?

A.As your mother is alive she can take her share in her father's property, But if your mother has relinquished her right by giving her share to her brothers then both of you do not have any right to claim over that property.

A.Dear Sir,
The logical and will be seen only when you approach the Court and pass through the process. Lawyers are not judgment writers and judges have no independent authority except to base their judgments on the basis of legal evidence and the Trial Courts only base their judgments on facts whereas High Court look into legal points. Thus, you get logical end when you approach High Court after several years.

A.As your mother is Alive she can take her share in her fathet property , if your mother if your mother has relinquished her right by giving her share to her brothers then both of you do not have right to claim
