We entered into a development agreement with POA with a developer of our property owned by my mother in west bengal. We are 3 co-owners of the undivided property including myself, son and daughter of my predeceased brothers. I want to sell my allocation of flats of the nearly completed project. We have a joint mutation certificate in the names of all co-owners under local municipal body. I believe partition is not mandatory if NOC of other co-owners is obtained along with an agreement defining allocated flats in metes and bounds to all co-owners by developer. But developer is suggesting partition deed (which would entail stamp duty and regd. charges) citing local municipal body viz. South Dum Dum Municipality will not accept mutation individually without registered partition deed. Is it a fact? I want your valued opinion regarding what to do in my scenario with minimum expense so that I can sell my allocated flats once developer hands over the CC. Can the supplementary agreement with developer for flat allocation and other monetary dealings arising out of less/extra space allocated to the co-owners be registered?

A.It all depends upon the purchaser. Take signatures of co-owner and sell property directly.
