My friend got married and her wife was insane and he wants to divorce her. But, she (the opposite party) is not appearing in Court for hearing, now, how to get divorce from her. Need your advice in this regard.

A.Dear Client
As per your inputs your friend need divorce from his insane wife, insanity is a ground for divorce, your friend can file a petition for nullity of marriage in the court, file the petition and issue the court summons to your friend's wife then the court will issue exparte decree if your friend's wife do not attend to court

A.Dear Client,

If you neither go to attend the court nor your advocate attend then court will give next hearing date and if it happens two ,three times , court will give ex parte judgement against you, opposite party will win the case without any effort and you have to give what ever opposite party demands in the court.

A.If u have filed the divorce case and opposite party is not appearing despite service ,then opposite party will be proceded ex parte and u will get the ex-parte decree of divorce

A.Dear client First take her to the good Pschatric Family Hospital and give him all support for at least 3 months to 6 months take care make her love .....making feel happy her wife take torusim rides of natural sites.,,, Things go green avoid divorce, once married it is married....please avoid divorce Regards NITHYANANDAN.S.,.,. A.Hi ,

Hindu Marriage Act considers, a marriage is a valid one if either of the party is ab idiot or lunatic at the time of marriage. A Hindu marriage is voidable if-
•If any if the party is incapable of giving a valid consent as a consequence of unsoundness of mind or

•Though capable of giving a valid consent has been suffering from mental disorder of such a kind or to such an extent as to be unfit for marriage and the procreation of children, or

•Has been subject to recurrent attacks of insanity. In the above-mentioned three circumstances, the marriage can be held null and void. Additionally, if the marriage has not been consummated due to impotence of the respondent, the marriage can be considered null and void. Also, the marriage can be considered null and void if that the consent of the guardian was obtained by force or by fraud; or the respondent was at the time of the marriage pregnant by some person other than the petitioner.

So, your friend can easily apply for a decree of annulment of marriage .
