Visited a doctor for my mom's face pigmentation treatment. After consulting doctor for multiple sittings, things turned worse. So we connected with another doctor and got things resolved. But we had left a Google and Practo review. Now doctor has put a defamation suit against my mom

A.you not received notice before suit ?
civil Defamation or criminal Defamation ?
now your mom have to contest the case and prove your review using case papers.

A.Hi,
since he has already filed a defamation case against you mother, thing you can do:
1. hire a good lawyer to represent your case.
2. collect evidences which show that you were not satisfied with the work of that doctor which led you to visit another doctor
3. all the prescriptions and visiting details of your mother will act as evidences.

you can even file a case against him:
since this is a case of medical negligence, you could have filed a proper complaint to the State Medical Council against the concerned doctor, practitioner or authority. The victim may file a complaint via the consumer court or a criminal court a per the nature of the negligence.

A.Hi,
For the most part, reviews are covered under the fundamental right- protection of free speech.
If a customer posts a review that is factually inaccurate or contains accusations about the business that are untrue, he can be sued the online reviewer for defamation.

Having said that, since you consulted this doctor multiple times and were unsatisfied, hence the bad review.
you can plea this in the court and provide evidences which must include the prescription note, the proofs of visiting the doctor.
Also, the parallel prescription from another doctor whom you referred after being unsatisfied with the first doctor can be included- This prescriptions must indicate that the there was a lag from the side of the 1st doctor .

A.Had he issued notice to you before filing the suit? You have to defend the suit and put your side before the court.
