Need Legal advise on admission of mentally ill
3 years ago
My mother has been diagnosed with Paraphrenia in July 20. We had admitted her in hospital after a violent pshycotic episode but she refused to accept her illness n was discharged early. She is not taking her medication which has made her extreme violent, abusive and dangerous. Now my father is only staying with my mother and now suffering her latest pshycotic episode. How can we get my mother admitted to hospital ? My mother is non - cooperative. Is there any legal way that we can ensure that she can be hospitalized longer, till she actually becomes receptive to treatment?
A.Hi,
Under S.89 of the Mental Healthcare Act, you can make an application for a mentally ill person who is not receiving treatment and is a danger to himself and those around them. This will have to be corroborated by an independent psychiatrist over a period of one week, and only if he is satisfied that your mother needs hospitalization will the section apply. Once the conditions have been met, then your mother can be institutionalized until she is better.
