We Booked 3 under construction flats in new panvel by an agent in 2016 by Giving certain amount of money, he told us to pay remaining amount By bank loan and also no any agreement is made and now due to financial problem we are asking him to cancell the booking and return the amount , he is saying some amount will be forfeited by Builder , please give solution for this

A.Generally your position in the agreement goes according to the terms and conditions made. As u said there is no agreement made between you and the builder. You should first see in which year the builder had promise you to hand over the property if that date is gone then you can approach RERA for further remedy. You should also check whether that builder is RERA affilated Or not.

A.Hi,
This will depend on the terms and conditions of the sale agreement.
There might be a clause preventing you from claiming a full refund in case of late cancellation. However, you can claim some amount as refund if you have not yet been granted possession of the property.

A.Hi,
This would depend on the terms and conditions of your sale agreement.
You might not be entitled to get the whole amount refunded if you are doing a late cancellation.
